1) Policies of Cingular will stay the same whether you are at Best Buy or at a Cingular store.
2) You can pay the "no commitment" price for the phone (currently $299.99 at my store). You can ask to keep your rate plan the same. (It may be incompatible with GSM service, but most are not.)

At Cingular stores in my area, the 1-year contract price is %50 more than the 2-year contract price. (You still get that nifty rebate, though!)
Best Buy may have another policy.

Well I just checked w/ Best Buy. I can get it for $150 w/ only a 1 year contract. After the $100 rebate, I'll have only spent $50 for the phone.
