Class action versus Jamster.com???

I'm surprised the FCC hasn't stepped in and shut down Jamster and their ilk altogether yet.

such as a caller i had with nokia 3560 that cannot download, janster t&cs say "you agree that your device can dl material...." even if it can't, u agreed it could , so they can charge u ... sorta like agreeing your car can fly, even tho we both know it can't ☚ī¸

Its the same(KATAZO) as jamster, but mblox is there billing system they use to chargs, if you use jamster, they use premium mobile service

I use smashthetones.com. It's the greatest website ever. It is just a mms charge (.25) and you can have mp3 or poly tones. The downside is you have to use your own song to start out with and the clips can only be 15-30 seconds long....but I'm not too picky, so it's perfect for me.

If you followed the sencondary link to the InfoWorld article, it says at one point:

"VeriSign and T-Mobile declined to comment on the suit. Cingular, which now also owns AT&T Wireless, could not be reached for comment."/

hmmm, sounds like they must have tried to call the Cincular customer support line. đŸ¤Ŗ

I'm sorry, i'm not for them in any way, but jamster would not lose in that case, thats also why Jamster is not getting any Heat from the FCC.When you sign up for it through text message or Internet, they do give you the T&C, in the message, i know i have access to read incoming texts on the blue side.

Jamster may do their service based on customers not reading it, but the person is not any less legally bound since it was given, its like anyhting agreement, you are given t&c, and by you proceeding after being given, then you on the hook. its the same as the contract for 1 year from the carr...

That's not completely true. Contract law states that there are multiple aspects of a contract. A mutual understanding of the commitment is important, and if they find that a reasonable person wouldn't believe that are in an agreement, then the contract is void. As well if a minor is using the phone, then their contract if void because adults make contracts with minors knowing the agreement can be null and void at anytime. (that's a fairly unknown fact. Minors can 90% of the time get out of contracts even if the contract seem to be completely legal) Also, if it can be proven that jamster is purposely decieving customers even though there is a contract, then the customers can also seek damages.

I just took my contract final in my civil law ...

There are 6 elements a contract must meet to make it enforceable.

1. Legality - everything's legal with the Jamster stuff
2. Consideration - information is exchanged for money
3. Proper Form - it's in writing
4. Capacity - Unless the guy's retarded or a minor that owns the phone, there's pretty much nothing they can do
5. Agreement - Jamster agrees to send info, User agrees to pay
6. Genuiness - Although it may seem Jamster is out to deceive, everything is up front.

Now, I haven't read the terms of the contract with Jamster, but I've glanced at the bottom of the screen, and, sure enough, just as I expected, you're set to receive monthly bills. It's there for everyone to see, it's up to the end user as to whether or not they read ...
