Using non AT&T unlocked phones for texting

Can I use a non AT&T smart phone for calls and texting only and not get a message that I need to get a data plan with the phone I am using? I tried an AT&T Blackberry and got this message. I am told they can track the phone by the ID on the phone. I am not interested in a data plan as I only do texting. Any help would be greatly appreciated.

"I am told they can track the phone by the ID on the phone. "

This is correct. We can track the phone.

Thanks for the confirmation. Then I assume that they cannot track a non AT&T smartphone and I can use a T-Mobile phone?

Get a non-smartphone, dude. BigBrother will find you.

I currently use an unlocked/non-branded smartphone w/o a data plan. You can use this method but if you click on the internet by accident then you will get the message that you will need to add a data plan.

Another option is to put your sim card in an old basic phone. Then call At&t and add the data block to your account. Next take your sim card and place in the smart phone that you want to use. I would still caution not to use a Blackberry nor any At&t branded smartphone.
