Miserable experience with AWS

Ok check this out. Cust service care reps only please.

While working for Circuit I had an AWS employee GSM plan.

When I got laid off I switched my employee plan to a GSM nationwide plan. I asked three times to see if I was under a contract. Each time the answer was no.

This past august I went to Texas for 2 weeks. I took my wireless phone cause it was a nation wide coverage plan! It was one awesome drive.. All the way from the New England area to Texas and back home through the southern states.

At no time did my phone ever indicate roaming or anything else other than AT&T Wireless digital service. Woot!

I get home to a $282 phone bill. Apparently the customer care rep DID NOT put me on the nationwide plan. Not only that but I ...

Actually the moment you changed from a employee account to a monthly reoccuring service you were under a 1 yr contract. The plan sounds like you were on a local and your phone can say ATT all day long and if your out of the home calling area you pay roaming.

No not at all I uphold policy and take my job serious however bad apples screw it up for everyone else and you.

If you want out of the contract do a change of finacial responsibilty or COFR and you dont pay a Early termination fee and they dont pay activation fees.

Lets starts of by mentioning that if you had Unlimited NW minutes or LD or extra minutes promo's you would have a MINIMUM 1 yr contract according to the terms and conditions of service and you are agreeing to these terms by using the service.

Second thing is the display on your phone only indicates the towers you're getting service from. If you're on a National plan that's fine but if you're on a Local Plan that when your phone reads doesn't matter.

Third thing is no customer care rep would transfer a customer to distribution services. That's the dept. for indirect dealers (such as you were with Circuit). Very rarely would any rep OFFER a supervisor without being asked for one and i find it hard to believe that a "supervisor" would ...

Spawn hey that would all work but I already had free LD and nights/weekends on the employee plan. I wasn't geting anything different on any regular plan other than I went from about $15 a month to $40 a month.

Also I asked three times about the contract length and each response from that rep was no. ☚ī¸

As by legal law and the BAR association - a contractal agreement between two parties must have either:
A. Written/signed documentation
B. Oral/verbal acceptance with a 3rd party as mediator
C. Either of these two by an authorized proxy by the two parties

Since I gave/had none of these I don't consider myself under contract. When I used to activate AWS the care reps would ALWAYS speak to the customer and ask them which contractal le...

Hmm that sounds like customer misinformation and actually you should have gotten a rerate plus if you didn't agree to a contract and there are no notes to that efect then you are off the hook however, if you changed your family of plans you automatically hvae to agree to a new contract

Your WRONG if you change from a employee account to a individual account you are automatically under a one year contract. As a AT&T employee you should know that and he was not mis informed he failed to call to confirm his rate plan. Any mis information that "was" given was told from a distributions rep that probably didnt know what he was talking about. Sorry but the best thing to do is call and ask customer care where your calling area is. If you wanted prepaid that is without a contract but if you pay a MSC and just went from a employee account ............you are under contract and no law has been broken and no misinfo will get you out of it. it would help if the cust would actually listen to what the rep says to them. most people use the time that rep is talking to think about what they are gonna say next. its true. ever now and again i will ask the cust sumthing really stupid just to see if they are listening.. they will say yes to almost anything.

Heh I get that in the store sometimes as well..

Anyways I got my case heard today (3/26/2004) vs AWS about my charges.

I was found to be cleared of charges as AWS could not provide a signed/verbal contract of any form.
The small claims court judge found that it was a case of customer mis-information on the part of AWS.

I was cleared of the $482 but I still have to pay the $282 which I accumulated. HEY that is fine I mean if AWS DIDN'T charge me that term fee under a non-existant contract I would have cut them a check THAT DAY. My $282 charges = my fault. I always pay/take responsibility for things that I screw up/accumulate.

Score one for the little guy!

Either you're lying again, or the judge is stupid. Read your terms and conditions pal, they're legally binding, "If you accept any promotion for greater then 30 days you automatically agree to take that promotion for its full term or result in a termination fee.." etc etc.

#1 calling me a liar when this happened to me is insufferable. IF I was going to lie I wouldn't make this story up. Never accuse me of doing something that I didn't do or saying I am lying when I am telling the truth.

ALSO re-read my posts. I did not accept any promotion. Everything I had on my employee account was exactly the same on the national (read local) plan except for the difference in minutes and price.

#2 You are taking this WAY too personal. This is NOT a slight vs the customer care reps one bit. It's a slight against the way my account was handled by a supervisor. It is NOT a slight against the AWS care reps that post on this board. It's just hard fact and truth and I'm sorry that you are taking it as if I am attacking you....

ummm a rep would not have gotten you a supervisor and transfered you right through without looking into it first plus they wouldnt threaten you with credit when they do not know for sure how it works... dealers causing problems like usual hmmm
