Customer calls in to make sure she is still getting her free phone from AWS because she did the Customer First Program, well I advised her that unfortunately AWS sold out of phones. She didn't get that she was boned for a phone from AWS. It was to her stong understanding that she is going to get a 100% free phone from AWS with no shipping and no upgrade fee.

I laughed in my head, I just felt like telling her that she is never going to see another TDMA phone from AWS. I told her to try E-Bay or make the switch to Cingular. Well as soon as I mentioned Cingular it's like I spoke the taboo word. She was adament about NOT paying an upgrade fee, she even walked into a store and reprasentative there told her full price and $15.00.

I mean come...

I know this but the stupid thing is she stated this is the contract she signed up for. She thinks this promotion is the only thing binding her to her contract.

If she can't get an AWS phone for free then she will probably argue that we have breached her contract. Then it turns into one of those situations where they state we can let them out of their contract for free.

It's these situations that make me think why can they think this way and still survive in this world. The sun doesn't revolve around them.

Well this is what i would do, first see if she/he even signed the contract.check at awscontractservices andthen if she didn't say you never signed -Na-na-na, too bad. Then if she did, ...

the beauty of the verbiage of the customers first promise was that it was "'A' free phone every year, and if you are not happy with the free phone being offered then other phones are available at 'currently available discount pricing'," meaning that there was never any statement that any customer got ABSOLUTELY what they wanted or even that EVERY phone would be free...
... if the customer signed verbally agreed to (1-year) or e-signatured (2-year) the contract, the contract is no less valid because of a merger

actually per the terms and conditions of the customers first promise, they may be required to change their rate plan to get a new phone. That comes straight from RES!!! Sorry if I repeating something someone else has already said. 🙂

I think i had that exact call today, offered Cingular first, she declined, offered the woman her "free" phone which happened to be exactly the same as her current TDMA phone (Nokia 2260) she went for the Cingular equip and migrated husbands phone as well, advised of the Activation fee, fought me for a second till told her that it was to cover the cost of Cingular paying ppl to set up her "new acct" w/ them ... i thought she was going to escalate, but then she backed right down, and i get all tingly when i feel an escalation coming on ....... a good tingly feeling wasted 😳

Last time I checked and this may have changed since I checked last but we can migrate CFP customers to orange and fill out National work request to get 18 waived.

As we are still honouring it we are giving them a free fon and everything didn't say it had to be ATT in that anywhere.

Might wanna look into that people

no its not being waived anymore, since when this was ATTWS, customers had to pay the $15.00 upgrade plus $9.95 shipping, so this way they pay less.but they still have to pay it

You wanna mess them up, go to the customer first program site on attws.com, then once there get them to click on the terms it "states"

they may be required to switch plans to receive the benefits of this program, also they are required to sign 1 new 2 year term of service at the same time.

Thanks for re-iterating the fact that they may still have to change their rate plan to get a new phone!!! I told a lady the other day when she wanted to escalate about the Customer's First Promise, that per the terms and conditions she may have to change her rate plan to get a new phone I thought she was going to blow! She was so mad at me, but I told her that the new phone (nokia 1100) happened to be that free phone and she could either take it or leave it. Read the contract people! And please, consumers if you are reading this know that we do NOT wave the 18.00 fee to get the new Cingular phone. We dont even credit you $18.00 on the blue side. When ppl complain about that I call it an "upgrade" fee.....since they are upgrading to a new ph...

thats just whats in the terms and conditions on the ATTWS website, there is a link there to view your status, and right there is also a link to the terms that clearly states, you MAY be required to change your plan in order to receive the benefits from this program.

If the never read or didn't think it never applied to them they are outta luck.I tell them in a positive intial response kinda way, so I get em to migrate every time!

I always find it hard for the people that mention that offer then come to find out they never signed up for it. Sucks for them, but then I make it sound like they did by giving them that spiel. 🤣 🤣 🤣
Some get mad, but then what can they do?

Yep, i love the ones that think the company is not smart enough to check and see if they signed or not.

It's like well you never signed the contract so since you didn't you can't have the free phone, oh but since you changed your plan 2 months ago, you are bound to a new 1 year contract from that date. They drop their jaws to the floor when you tell them!!!

Well you are both right and wrong, cust should not have to pay an upgrade fee, this inclds going to Cingular, if you dont trust me ask you TL they have been told how to file an NWRS that will waive the migrate fee, and when you put thru one of these CUP it will not charge an 15 dollar upgrade fee (have done it myself). but about getting another TDMA phone unless she broke hers or it is not covered by WEX then yes she will not get another, however she should be able to get at least one free Cingular phone. by the way had an esc about this very issue today.

Got the NWRS e-mail a couple days ago.

I don't put through CUP orders anymore, never have, never will neither will my supervisor.

She shouldn't if she escalates and states she is one of those loyal long term customer's who feels that we should bend over backwards to correct her error's or every charge she feels she should not be charged. Yeah when they tell us we have to give them credit for that then I might consider it, until then they all have to pay. This company needs to make up costs and if the customer isn't willing too then thats their problem not ours.
