The State, who can obligate companies to charge their customers, obligate them to charge taxes. Surcharges are not taxes directly from the state; if they were, they'd be taxes.
Cell phone companies have caps in their service for two reasons:
1. Mo' money.
2. In order to protect their network.
They don't do so because the government says so. The limits some place on services are explained as such, and such they are; if the companies could use the Big Bad Government as an excuse, they'd use it in a heartbeat.
As a Sprint rep, I know that we do not in any way cap internet that we claim is unlimited. Same goes for phone calls, as long as they're on our network. T-Mobile equally does not throttle their unlimited users.
