yes it would be covered the only issue you could run into is they could ask for proof of purchase.

They'll only ask for proof of purchase if the serial number is not registered on the account, which is only possible on Nextel phones. Sprint phones must be registered to work at all, so there should be no problems.

Right, but they don't actually check the serial number until the claim is actually placed. Once again though, no issue for Sprint phones, as the phone will not work if the serial number it not registered.

If I were you, get the serial number and check it in with care, then call care to get the MSL from the phone. Call the guy and have him hit ##MSL# and see if it brings up a menu. If it does, buy it. If it doesnt, its been flashed to another provider like Cricket or Metro and although you can still "activate" the phone in Sprints system, you cant program it with your phone to use it. So be careful theres some shady people. Although the ESN is clean and can be activated, make sure it can be programmed and hasnt been flashed! Once you flash it, it CANT be flashed back. No matter how many times they tell you it can be done. Save yourself the trouble, it cant.

The phone would be covered however Assurion will not replace the phone is there is not usage on that phone. Sooooo if the phone is broken don't buy it assuming you can just do a claim on it.

Ooh, I'd forgotten that point. Yeah, this is accurate, you must be able to make one billable call.
