This will definitely hold up in court. However compensation for damages ROFL greedy bastards. Refund for the service that was not provided that is logical, restitution for the lawsuit makes sense... Good luck RIM you have a world of pissed off people. Major fail. 🙄

I'm not sticking up for RIM but wouldn't that be an "act of God" or force majeure as stated in some contracts?

For example if cable goes does and service gets interrupted they'd still bill you the full monthly plan, right? And I don't recall reading about and class action lawsuits against Comcast for service interruption. Now whether or not you call and negotiate a credit from them is a different story.

In RIM's defense they're offering $100 in apps even though typical full monthly BIS or BES fees range only from $30-$45.

I rather doubt it, maybe in the Ninth Circus, but nowhere else. RUN never promised that there would be 100% uptime with absolutely no possibility of an outage ever....


Companies have service outages all the time, Google is legendary for their constant outages, in the last month there have also been outages with Yahoo and Microsoft......not to mention outages with cable, satellite cell phones and home internet which are legion....

not to mention that the outage just meant you couldnt get your email on the go. That doesnt mean that you cant still read your email or reply to it the old fashioned way...by desktop. Sure, its not as efficient but its not like its the end of the world. People need to relax a little. If I lose power I dont cry that Im gonna starve to death because my refrigerator and microwave doesnt work...I just have to go to plan B.
