Why would MS get paid for selling an Android phone and not a Windows phone?

I don't get this post on Phonescoop.com. Why would microsoft get paid for every Android phone that is sold and built by HTC/Samsung? Wouldn't Microsoft benefit if they sold a Windows Phone device that was built by Samsung/HTC?

Can someone clarify, or am i reading it wrong?

I think this gives HTC/Samsung patent protection against Apple's litigations if I'm reading this correctly.
