Incorrect, word on Android pre-dates the release of the iPhone...Android Inc was founded in 2003 and was acquired by Google in 2005. Confirmation that Google intended to build a mobile phone was in December 2006 and the first build of the Android OS was published in November 2007.

The development of Android is largely if not entirely independent of Apple and even if the iPhone was never made Android phones would still exist.

Coming down to technicalities, Google's concept is draggin an item (i.e. the status bar) downward to reveal a drawer while Apple's is a swipe to reveal a new screen akin to swiping left and right between different app menus. So there won't be any lawsuits, even though the two concepts ARE nearly identical. Yayyy patent law!
