Laws are supposed to protect us from criminals, not save us from our own stupidity. If you made a choice to purchase and download an app that specifically stated it has access to "location" that's your fault!! Not the developer, not the carrier, not the phone manufacturer! It's not surprising that the education level in our country is failing when compared to countries. The Federal Government doesn't want Americans to have to think about anything.

Sadly, you're contributing to the "stupidity" pool there. If you knew what the situation was you wouldn't of made the comments you made.

Actually, this issue arose because user found out that their location data was secretly being stored from their iPhones. They didn't download any app, have an option in the settings to turn off any sort of "track me" option, etc. It...

Actually, the disclosure can be found in the terms and conditions that one ACCEPTS in order to use the iPhone. However, I do grant you the fact that it is not immediately brought to the user's attention as it does not pop-up like on Android.

Yeah but come on, like anyone reads the T&Cs. South Park had a great episode about all this. Android handled things well, they probably did that knowing that people don't always read all of the T&C so they doubly protected themselves.

You're right NOONE reads T&Cs, but to play the devil's advocate, it can be considered laziness. I actually sit and read my owner's manual when I get a new phone. I had to with this Android, it is my first. Used to be RIM all the way.

Since when is it Apple's problem when people neglect to read their T&C? And using South Park as a credible source is completly ridiculous...you can't possibly compare real life to a cartoon on Comedy Central. I saw Daffy Duck blow his beak backwards with a shotgun in one episode, so if I go home and shoot myself in the head with a shotgun and die, is it someone else's fault? Same thing here.

They provide a full T&C for you to read, and if you don't read it, but still click "Accept" that's your own fault for anything that happens thereafter. Would you sign any other contract without first reading it over, or having a lawyer look at it first? I sincerely doubt it.

If you have a copy of the T&C before this fiasco, I'd love for you to actually QUOTE the section that states that GPS information is stored on the device in this manner.

Unfortunately, I do not have access to the pre-fiasco T&C. Then again, I'm not the one making the claim that it was stated in there ;)

I'll give you this much, if you find and quote the exact section that states this, then yes. I'll agree that it is the fault of the user. ANY contract should be read in its full. No excuses.

But, even with that... it is a bit unethical to store this data in this secretive manner. Hell, I'd not only be upset about the privacy invasion, but the fact that the device is consuming more storage space and clock cycles (no matter how ...

This is much to do about very little. Folks you are being watched. If you didn't already know that and understand how it worked, then you knew nothing about how cell phones stay in contact with their networks. The cops only needed a count order to have your carrier to give up your location and who you call and when. I done care if someone finds out what brand of butt-wipe I buy.
If these senators really wanted to protect the common man, then ask TSA why the hell they have to check out baby diapers.
