The Galaxy line of phones looks a LOT like the iPhone

There is no question about it.

I don't know if Apple should sue or not, but these phones are incredibly similar in style, to the point that it almost seems like Samsung is blatently copying the look and feel of Apples products.

Apple has tried the 'copying look and feel' argument before and their lawsuit was thrown out of court, you can't patent 'the look and feel' of a product.

Look, the idea of a rectangular, slate phone with rounded corners that has a UI which is a row of icons is hardly some great innovation.

If Apple can sue based on this, then there's a whole host of companies that need to step in and sue Apple, including:

The Nokia 7110 (1999) was the first phone with a web browser....

The Benefon ESC! (1999) was the phone with GPS

The Samsung SGH M-100 'Uproar' (1999) was the first phone with an MP3 player

The Nokia 3210 (1999) was the first phone with predictive text

The Ericsson R-380 (2000) was the first phone with a touchscreen

As far as I know, Apple pays royalties to every company that holds any patents it uses.

And honestly, the chrome bezel around the Galaxy line of phones (specifically the Vibrant) and the four stationary icons on the bottom of the Galaxy line of phones had me immediately wondering if Samsung had simply copied what Apple did.

On top of that, the icons on Galaxy S phones seem to mimic iPhones down to the look and feel.

Apple has a legitimate case here. I don't know anyone who hasn't looked at a Vibrant and NOT said "hey, that looks a heck of a lot like the iPhone... weird"

There is always similar traits between phones. Samsung made a bigger touchscreen with a clearer screen, and can expand the memory. Aside from that it has 4 buttons at the bottom instead of 1. The OS is android made by Google, so the icons looking the same are not because of Samsung. Apple is bitting off more then they can chew here.

This case reminds me of when they tried to claim Microsoft had a monopoly just because they were more user friendly the the Mac. They are losing money and now are trying to sue everyone else instead of try to compete...

1) There are always similar traits. But a good reference is how many Samsung Phones looked anything liked the iPhone before the iPhone came out. None. None were even in the form factor.

2) The "Luxpro Super Shuffle" had an FM equalizer too. Throwing in an SD card reader doesn't mean they're not copying the look and feel

3) Samsung actually modified the Android icons to more resemble the iPhone's. They're not at all part of the Android Human Interface Standard

4) The Chrome Bezel is really the giveaway here.

5) Apple is definitely not losing money.

How many flip phones were there before the Motorola Startac? None. And then almost immediately it seemed every phone on the market was a flip phone.

And yet Motorola didn't sue anyone.

And the flip phone is far more innovative than the slate.

Same with the iPhone slate design. It's an 'obvious' kind of design which had appeared in science fiction movies and TV shows for years before Apple started using it. (Just like Motorola got the idea for the flip phone from episodes of Star Trek, hence the name 'StarTac' an obvious homage.)

I would say the Samsung Slate phones bear far more of a resemblance to the iPhone than say, a Samsung A250 to a Motorola StarTac . Right now I'm seeing an ad for a Galaxy S 4G and the basic form is identical to my old iPhone 3GS- down to the chrome bezel.

And you absolutely can trademark the look and feel of a product- hence Apple being granted the trademark.

Samsung Omnia i910
Samsung Eternity SGH-A867
Samsung Behold T919
Samsung Memoir SGH-T929
Samsung Finesse R810

All phones with the chrome, and all rounded edges, and all look close to the Iphone in some way...

The Android icons can not be argued that some do resemble the iphone's, but that alone is no reason to sue.
