In those instances one simply shuts the ringer OFF....

Because it will most likely be laying down at night, and is somewhat vertical in pocket.

The phone has a clock so maybe it's also tied into the clock and will no when at night it won't go "Siren" mode anyone. Who knows, they have a lot of time to work the kinks out of this before the HTC EVO later this year is released.

"Later this year"? What like as in 2 months from now? June really isn't all that far away. Or at least it better not be there's some Blu-Ray's coming out June 7th that I want.

Other manufacturers and software makers have made the same mistake in the past (see: Palm Pre running 1.0)

The alarm didn't function if you turned the notification sounds all the way down. I heard about that one constantly until it was patched.

I'm just saying, that idea could prove to be a flaw, not functionality.
