Constitutional? When has a little thing like that mattered to the republi-crats since FDR?

Just because the constitution doesn't grant the fed goverment to do something means nothing, I am sure there is a judge somewhere that will say it is okay.

What's the problem?

Let's remember the reason the FCC was created in the first place was to shut down radio stations that were critical of the New Deal...

The purpose of the FCC is to silence and censor speech the government finds unacceptable

What I would love to know is, if we assume that the authority of the federal government to regulate the airwaves is constitutional (itself a dubious notion, but let's grant it for the sake of argument) why do we need a separate agency to make the regulations?

Any regulations that may be needed can just as easily be debated and passed by Congress....

But the reason that Congress and the White House like to delegate responsibility to regulatory agencies like the FCC is so that they can evade responsibility.....'...

you guys should pay more attention. several people spent hours, days arguing that net neutrality was unconstitional. one of them was trenen. i was being facetious.

Article I, Section 8, US Constitution, gives Congress the power to regulate commerce "among the several states." It also gives Congress the power to make all laws "necessary and proper" to carrying out its Constitutional duties. In the decision of McCulloh v. Maryland, the Supreme Court ruled that the Necessary and Proper clause is meant as an expansion on Congress's enumerated powers, to allow for the federal government to be able to adapt to changing situations and times. It also ruled that, so long as the desired ends are Constitutional, and the means Congress chooses to use are not specifically prohibited, then Congress can pick what it thinks is the best way.

shut up lawson, go back and read what i said. i said i was being facetious. i agree with you 100%, i was just hoping trenen would come over to this article and troll some more, and lulz would ensue. but that didn't happen, and i'm really disappointed. instead, everything i said went completely over everyones heads. i guess there are still lulz because of that alone.
