Unless I am not aware, does Verizon and Cingular transfer all of your content to a new handset when you buy it? I don't think so.
This is no different. When you "purchase" the ringtone, you own it on your handset for however long you keep the handset. After 90 days, you simply re=download the content (do any other carriers even have an online content manager to re-download from?).
