With Apple having a bunch of patents all involving multi-touch good luck getting a "cool" phone when all this is over.

That's assuming the patents hold.
Patenting an "Idea" is stupid. Software programming, hardware design, of course. But saying "we don't care HOW you made it work, since it looks similar, we're going to sue" is counter productive.
