They already went after HTC and HTC pled guilty and struck licensing terms. So I'm gonna bet on Microsoft for this one.

HTC decided that it was easier to pay the fees than fight it out in court. paying the fees doesn't mean "pleading guilty"

Apple-Being sued by Nokia and dozens of other companies. Why (according to you) because they're popular.
Android-Gets sued by companies because they're popular (using same rationalization) but suddenly the lawsuits have merit.

Well, considering HTC has already pled guilty and worked out a licensing arrangement for this, I'd say there is some merit, though I don't think it's too different.
That said, I think Oracle's lawsuit about Google plagiarizing Java so they could skirt the GPL and HTC ripping off of Apple's UI designs are legit. Nokia trying to tack on something to the standard GSM license because their R&D has been sterile for a decade is a little different.

they worked out an agreement, they didn't "plead guilty" sometimes paying the fees is easier than fighting it out in court.

Blue, I don't believe that anyone has won a lawsuit yet. Innocent until proven guilty and all that.
Better yet, I know what will fix this for Motorola. Simply make a few Windows Phone 7 handsets and watch Microsoft's lawyers suddenly forget that Android infringes on anything.
