Law Firm That Sued Zynga Now Investigating Apple

The reason this won't work...

The problem with this lawsuit is that there are a lot of phones out there that will lose service if held a different way. Nokia put up a nice little blog saying that you can hold their phones any way you'd like, but users then posted a ton of videos showing not only Nokia phones, but HTC and Motorola smartphones (Droids) that also lose service when held a certain way. Unless these guys plan on going after every single manufacturer, they aren't going to win.

Another problem is the fact that the FCC forces manufacturers to put the antenna at the bottom of the phone to as far away from the head as possible. The idea place for an antenna is the top of the phone, but that wouldn't pass the FCC.

ok I've watched the two htc phones and to be honest these are stretches to say it is the same as the Iphones problem. the incredible lost one bar and then he had to take the battery cover off in-order for it to lose a major signal, and with the Nexus one it lost a greater signal indeed but his hand was cupping the back and bottom of the whole phone. what i do find interesting is that both times when they showed the signal go down there were zoomed in and most of the videos I've see on the Iphone it was zoomed out and holding the Phone in a natural position. I agree that all phones do it but none that I've seen so far that do it to the extent of the Iphone. I'm going to watch the rest.....

JeffdaBeat just proved that all phones are susceptible to losing signal when the user covered up the antenna, so your new argument is that Apple should be sued because the iPhone is more vulnerable (without any scientific proof) to the user?

how was that his point, strawman argument much Mentat? He's only saying that in a much more natural hand position the iPhone experiences signal degradation. Those other phones you have to do some hand ninjitsu in order for it to happen.

You are right on this one point, Mentat, this is an absolutely ridiculous lawsuit. Didn't know I could be sued for stupid design. What a horrible precedent this would set for future litigation.

On the other hand we might see the Snuggy go down in flames... maybe not.

i said that ? wow i must of missed it.....let me see how to put this......no i don't think that apple should be sued with out scientific proof, do i think this case will hold up probably not. What i do think is that the Iphones Issue is much bigger and a lot easier to replicate then the examples that we're given......except maybe the Nokia's, Nokia should of looked at the three fingers pointing at them before they pointed the finger at apple. Now, if it can be proven that Apple knew about the Issue before the launch and said nothing about it and continues to say it's not a big deal and there is no issue, just buy a convenient apple case that was available at launch, then Apple should be held accountable.

Actually, I think I proved what people don't seem to know. Everyone has this hatred towards the iPhone...which is just a phone. It's an inanimate object. But folks seem to get off when there is something wrong with something that is simply a phone. Now I'm not saying that's you Kaztro, but it seems to be the the thing to do on Phone Scoop forums: Hate on the iPhone.

My point was that there are other phones out there that suffer the same kind of signal loss if held a certain way. People here may want to try to isolate it to just being the iPhone, just as the Nokia blog did, but we see that isn't the case. And unless you want to call all of these phones garbage and sue all of the manufacturers, then kill the hate on Apple and the iPhone. D...

well in a simple way your right.....but the problem is the hate isn't over the Iphone it's aimed at the Apple fan boys, who do at times have this unrealistic sence of entitlement, and when you do that any little thing gets magnifide. I honestly think this isn't a minor issue, and to see the Arrogance of Steve Jobs is a little deplorable. i don't agree with sueing over it myself. personally i would of returned the phone and took my busniess else were, that's personally how i deal with companies who try and screw me.

And that's another thing I don't understand. Folks talk of Steve Jobs character as if they know him and work with him everyday. No one knows his personality but those involved directly with him. Steve Jobs will generally reply to an email with a simple response, something we've seen in the past. And his track record has been him succeeding with customer problems with his basic responses. And was his response really that off? Nokia even says not to hold a phone a certain way to avoid problems with reception...all cell phone manufacturers do. Jobs reiterated that fact in a very basic way.

Now...I agree with something like this, he should have done a bit more than that basic response...but I also don't really expect a big apology or explanat...

Hate to point this out. Jacob is the wolf guy in Twilight. (I have two teenage sisters, so I'm reminded of this constantly. Not a fan myself.)

you missed the point man,

as a consumer i don't have to know Jobs presonally. He is responsible to me not i to him. people were saying there is an issue and his inital response was "it's not an issue". If i spend any money on anything no matter how much or how little, i want the people who built it to take full resposiblity for any issues and APPLE hasn't. all they have said is "well everyone else does it" and "buy a case". If your ok with that then fine good for you, but as consumers we should not take that from any company. Trust me if it was LG, Moto, HTC that had that issue, TO THIS DEGREE (because i understand all phones do it even though i've been trying like hell to get my phone to do it and it doesn't change at all in fact some i...

Nope. It does not hurt your case to pick and choose who to go after if others are in similar circumstances.

For example:
Say John Smith went to Bar A. At this bar he got drunk and the bar continued serving him alcohol. Then, he went to Bar B and got even more alcohol. Then, he went to Bar C and got even more alcohol. Etc. And, at the end of the night he hits your wife while drunk driving and kills him. You now have the option to sue Bar A, Bar B, Bar C, etc. in any combination. If you opt NOT to sue Bar C, but only Bar A and B, that does not alter your case in the least.

I dont understand your point.... Yeah all phones loose some type of reception when held in a particular way. But the difference with the iphone 4 is the fact that it looses all reception completely. Also it was dumb for crapple to put the antenna near where most people hold their phone. Most people hold their phone from the center down to the bottom. Who holds their phone near the very tip of the phone? It was a design flaw and with a very good lawyer I think they potentially can atleast get this case in court.
