Exactly, they pay the tab its their phone, not yours. Its just for you to use. This would be quite different if it was your own personal phone.

All this means is that this ruling referred to public agencies. No ruling either way was made about private ones.

Essentially, the best rule of thumb comes down to who paid for the phone and who is paying for the service.

Trust me on this one. Private employers will eventually look to this ruling and make their point that they'll have a right to spy on peoples' use of company provided phones. That's why I want to avoid using a company provided phone as much as possible.

Most companies have their employees sign a proper use of technology form as a condition of employment which gives the company the right to monitor company issued equipment including e-mail and cell phones.

Sorry justfinethanku, private companies do this on your company email already. No reason they can't do it on phones *they* gave to you and *they* pay the monthly tab for so you can conduct *their* business on it. Whaddya think Enterprise Servers do; they don't even need to snag your phone. Now if it's your phone, your monthly bill, that's another story.

Look you can't take a company car and just joy ride it to Mexico and get ticked when they fire you for missusing company porperty.

I was thinking the same thing.

I'm suprised companies haven't been caught using the gps on company phones to keep tabs on what the employees do on their off time. That would be the ultimate in BS.

Some do. I have had a few service companies ask for the devices they issue to their employees, who are on the road all day, to have an app installed that tracks their location. A company I worked for years ago had Quallcom devices in our vehicles that, not only did we get our work orders sent to the devices, but ther knew where we were at all times, our driving speed wether or not our vehicles were on or off, and what time we started our vehicles in the morning to go to work.
This would be no different that that if an employer wanted to monitor the Cell Phone they issued and paid for.
