Oh, I have no doubt that WebOS emulates many of the iPhone's UI and probably other behaviours.
However, Palm is not like HTC, they DO have a decent sized patent closet (7268775, 7007239 and 7296107 to name a few) which includes patents on device behaviours that the iPhone/iPod touch exhibit.
Now, I'm not saying that Apple stole those behaviours from Palm, but they do have the patents to use as ammunition against Apple for a counter suit if Apple comes at them.
While I don't believe that Palm would end up winning in such a battle, I would think it would soften the blow dealt by Apple.
A shame too, as WebOS is probably the only other mobile OS that shows any promise. (As well as their marketplace since unlike Android they actually care about the quality of applications present)
