Ahhh to live in a country when people can sue for anything and everything.

I want to agree, but this seems like it may be a real problem. If customers are being charged the $1.99 for opening the Verizon page by mistake that's one thing. My issue is that VZW insists that they aren't charged for opening the browser by mistake. I have a hard time believing that there are this many people that don't know what they're doing.
Easy answer would be for them to simply state than any data usage is charged if you don't have it included in your plan.

Last time this claim came up it was said that Verizon intentionally designed their phones to make it easier to press the web key. Verizon was making something like 12 million a month just on these accidental presses. Of course Verizon would not be quick to fix this issue, its making them a ton of money.
I guess we will see what will happen with this lawsuit. Should be interesting.

Or they can always get a block on data like I have on 2 of my 3 lines, just to MAKE SURE there aren't any mistake/unintended charges.

Simple concept. I wonder why people don't think of that? Common sense is elusive I guess 🙂

I don't know about verizon, but if you block data on an at&t line, you block MMS, too.
...
Yup, the same applies for Verizon.

you're an idiot...
if you block "national access" (which is the full proof method) then you'd be right, but...
the issue here is "accidental" web browing (i use in quotations cuz i call b.s.).. then you can just add a mobile web block and still mms just fine... this also applies for program d/l, vcast music, etc.

Ask the typical verizon customer if they think looking at apps or browsing ringtones uses data. 90% of them will say no.

If VZW wasnt actively hiding the information from their customers about what these data charges were for, there wouldnt be a suit. Ask someone that has been charged one of the MB charges that says they didnt do anything to call customer service and ask about it, customer service can give general info about what can cause the charges and give dates and amnts of data used. Most of the time when I get calls about it, it is for a single transfer of .015 to .03 MB, done on the day the phone was activated. I am fairly sure most VZW phones are set up to do some sort of verification with the data network when they are activated that causes that transfer and it isnt set to be a free transfer.
