Mine connects to 3G just fine. As with any new device or service there will be hiccups. Lest we forget when the Iphone first came out all the issues that customers had getting them activated when you had to buy it at apple and get it activated through att.As for the ERF this is a very common practice among wireless dealers.I work for a national T-mobile dealer in Maine and everytime a customer signs up for service we take an imprint of their credit card and have them sign a paper saying that if they cancel service between 15-180 days we will charge them 350 dollars to recoup the cost of the phone that we still have to pay for and the loss in commission T-mobile charges us back.This is no different at all.When i worked for wireless Zone which...

I understand everything perfectly. College grad, here. And yes, releasing a $500 phone with problems holding onto 3G signals is very much a problem.

Not every phone is having this issue. Also we are still assuming this is a Google issue and not a T-mobile issue. Either is possible. Also a college grad here as well. I dont necessarily know that it means you or i have an innate understanding based solely on that fact though.

Early adopters nearly always play the role of beta testers, as most new devices still have some kinks. (I dont really care for this, but it's the product of people wanting everything now rather than when its ready.)
So if you:
A - bought the phone on release day or
B - bought the phone later but didn't do any research on problems it has had since release.
you can enjoy 14 days of use to see if the phone is right for you with no penalty if you change your mind and return it. I see no problem with that.
