Google Says Nexus One $350 'ERF' Is Necessary

I can see it now, some guy to ignorant to read the Terms of Service buys the Nexus One and then tries to sell it to a buddy for $100 more than he paid for it. Google then sends him a letter asking for the $350 he owes them and now the guy is upset he didn't read the T's & C's.
One thing that doesn't maje sense to me is that the
-DOUBLE- ETF is !!ABOVE!! the full retail price. Isn't the point of ETF's is supposedly to recoup the cost of the subsidy?
If you dont have the ETF on both with a 3rd party retailer someone gets screwed.
Its a common practice and makes sense when you break down the numbers.
The only people that should have an issue with this are scammers.
Its only an issue for 120 days folks. 4 months. get over it.
