If I have a phone rated at 3.6, and my network pushes 3G at 7.2, will I be limited to a 3.6 rate?

Without a firmware update you are correct assuming the chipset is 7.2 compliant. Not all are. What phone do you have?



Oh now wait, these are American phones... yeah good luck with that.

Actually the mytouch, cliq, and touch pro 2 are capable of 7.2
