No way! That's too much effort and money to give a ticket. Besides you can just argue that the cop was off by a couple minutes on when he witnessed it.

I don't recall where, but some guy killed a pair of teenage girls while driving, and the father of one of the girls had the calling records subpoenaed for the civil suit. The texter already had a criminal conviction for the accident & lost a fortune as well.
It's already legal to subpoena phone records for SMS & phone details in both criminal & legal trials.

I suppose if it were a serious enough accident (say you killed someone), then it would be worth subpeonaing your records. Or if a cop saw you and caught you, then you could be ticketed.
What I don't get is using your phone for other purposes. What about using your phone as a navigator or music player. Granted, standalone devices tend to be easier to operate than an all-in-one mobile device, but not by much.
