I don't think there would be too many individuals of corporate or business levels that would have lost Important classified documents as the sidekick is not a mainstream device for these applications. However, It is what is is and Attorneys will sink their teeth into this one.

Hitachi was hired out to perform this upgrade, Depending on the contract, I would think there would be a fair amount of liabilty here on Hitachi. Microsoft is definitely responsible for backing up their own info, but Hitachi should have informed Microsoft and never started the upgrade before instructing Microsoft to perform the backup before engaging in the work.
