How would they know you were texting prior to the accident?

I know if was guilty I wouldn't volunteer the fact that I was texting right before a crash.

I know when the train conductor crahsed, they knew he was texting because a message was sent a few seconds before impact. That would be a good way of telling. Plus, if the phone survives, it can be checked there...in addition to phone records. So if you survive the crash, but the folks in the other car don't...you will be held accountable for their deaths...or injuries...

You would not need to volunteer. In the case here in Rochester NY where five Highschool girls were killed in an accident, Phone records were pulled and found that the texts to and from the young driver's phone were being made up until aproximately 10 seconds before they impacted at 60 mph with an oncoming Semi with her text being the last one sent. Because of the intensity of the crash(All in the car were burned beyond recognition), This accident was high profile and is one of the cases that initiated national attention. The driver of the Semi saw the car veer in front of him seconds before the impact. If this ban is implemented full scale, Investigators may have the right to pull your phone records with any "Serious injury" accident whether...

Besides I think they also mean if cops see you texting you will get fined, not only if there's an accident.

Just like seat belts, if your in an accident without your seat belt on, how would they know if you were able to slip it on before anyone saw you didn't have one.

I was wondering when they were going to do something about driving and texting, especially with the teenagers. They get into enough driving incidents the way it is and texting only raises that to happen more often.

nothing stands up to a lawyer. period. in this example how do we know it wasn't one of her friends that was using her phones to text? not that I'm a fan of the whole judicial process.

That is a reasonable question. The only thing that they could determine is that she was driving and what was left of a phone was next to her. Either way, This has become a very serious issue. I narrowly escaped being t-boned myself by someone that appeared to be texting and driving. The person behind me wasn't so lucky. He got his bumper and part of his front end taken off. The funny thing was that the girl that missed me and hit him, was still texting when she got out of her car! Go figure.

Umm, the same way they know you just put your seatbelt on before they pulled you over for not wearing a seatbelt. It's going to be their eyes against your word. And how obvious is it that you are driving under the speed limit, slightly recklessly, and paying little attention to the road?
