Federal Lawmakers Step In to Regulate Texting and Driving

How do they plan on enforcing this?

How are they going to know who was texting or emailing? I know there is technology that can stop the device from communicating if the device is traveling faster than a certain speed. (say 20 mph) besides mandating the installation of the technology in all future phones, I dont see how they can enforce, regulate or prove that one was engaged in textual conduct. Or any lawyer worth his salt can figure out a way to get around this...any ideas???

to amend my previous statement, if there is an accident, surely there is a way to trace the sms history. but are they only going to enforce this on accidents? if so, its pointless, cuz the reason they are doing this is to PREVENT the accidents, not just figure out who to sue for my kid in a wheelchair

I believe the idea is to attach a larger penalty if the cause of an accident is determined to have been caused by someone who was distracted by text messaging. Or, maybe if you get pulled over for driving erratically, the stopping officer can check your phone for recent incoming/outgoing messages, kind of like submitting to a breathalyzer.

The second option seems a little too far reaching for my taste.

Are they going to void the Fourth Amendment to the Constitution which in relevant part states "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."?

Not entirely. It's the same as getting a breathalyzer. You CAN deny it, but it's a one-way ticket to jail. And you could simply lie and say you didn't have a phone on you. Besides, driving erratically gives probable cause, in the law's eyes.

Dark tinted glass give probable cause. The Patriot Act gives probable cause, as long as the officer is willing to swear that he felt that their could be a threat to national security in the vehicle... Probable cause is a dying breed.

First of all LOL @ "Textual Conduct" had me rolling. Heres the deal irreguardless of whether or not any of you believe this a driver texting is very easy to spot, and i dont care how alert u are, you might as well be driving with a blindfold, never ever passed by someone texting that was a safe driver, and u can see the phone when people are doing it, not hard to enforce. Fact is, people shouldnt even be calling when driving, and certainly not without a headset, Nevermind texting...IMO it should be treated like a DUI or DWI, it is definitely just as dangerous.

Just as dangerous???!!! You gotta be kidding me! Don't freak out and think that i am pro texting while you are driving (i am guilty of it on occasion) but to say that it is just as dangerous as driving drunk? That is ridiculous

Ok this was this girl that ran into the back of a guy going over 40 mph. There were no skid marks no signs that she tried to brake. She just slammed right into him because she was texting at the time and not paying attention. That to me is just maddening.

I wouldn't say texting while driving is as dangerous as drinking and driving but its still pretty close.

Although a drunk might not have perfect vision....His eyes and focus (whats left of it) is still in fact....on the road.

Someone texting...has their sober eyes off the road.

Ever heard of or know someone who can actually drive drunk? Ever been in the passenger seat with a drunk driver? Ever been there with someone texting? Idk...I would have to say depending on the quantity they drank and how far into "drunk" they are...drinking and driving might even been safer then texting.

I rather have 2 eyes with so/so vision on the road driving me home then 2 eyes with 20/20 vision off the road driving me home.

Of course, thats not saying much. I would actually rather walk then deal with either of them. I actually love life....and living.
