I'm curious about this what part of the early termination fee's did they say were illegal? Was it the fact they weren't prorated or enforced without cause? Just seems this is a hefty settlement.

I was wonder the same thing but the source artical never says what was changed in 07 that no longer makes it illegal. There must have been something with Sprint and VZW term fees. Also not sure how VZW settles for $21 mill and Sprint gets hit up for $1 billion?!?

I never saw what was so illegal about it or hard to understand. I always looked at it this way:

Sprint gives you $150 instant rebate on a phone for signing a 2 yr contract.

So basically they gave you $150 to stay with their service for 2 yrs. If you break that contract and leave before that 2 yrs is up, then you need to give Sprint their $150 back.. Plain and simple.

That's the same way I see it Big poppa. There has to be more to it though. If not how did At&t, T-Mobile, and any other cell carrier other then Sprint and VZW not have suits files against them? As well as the Dish companies...they charge ETF fees if you singed a contract them them and term before the contract is up.

thats absolutely right, and 99% of the time we give an additional rebate on top of the 150. besides, when you cancel, the retention department tells you that theres a charge of 200 for canceling. and what about the customers that didnt pay thier bill and decided to let it hit thier credit reports?

When I used to work for Sprint Customer Service that is how I explained it to customers and then they were ok with it, or at least understood it better. They would call yelling and complaining about it, and I was like:
"Here's how it works.. We gave you a $150 off on that phone when you signed up for your promise that you would stay with Sprint for at least 2 yrs. You broke that promise and now we want our $150 back. It's only fair, and you were told of the ETF fee when you signed up, and if you weren't told, you were at least told before you canceled."

This was back in 2000-2001 when ETF fee was $150.

Not that it matters. The whole reason around the whole etf thing is coverage related things. I fyou sign up for service and have coverage in your house, then it changes and you don't cell phone companies still charge an etf. Sprint won't get rid of discounts, etfs will be prorated. Also there is the whole problem of many compaines renewed committments for a plan changes. The other thing is that in trutchs Verizon, T-Mobile, and Cingular are really quite new in the phone game. What caused most of Sprint's backlash is long time disgruntled cx's from way back in it's home phone days. That and customer's who have been passed back and forth between Iden and Cdma only to find they still get dropped calls. And let's not forget those stubborn...
