If you take ETF away, you are going to shell out tons of money just to get the free phone as an upgrade. I can understand why they would sue but at the same time, they are going to ruin it for us all, just like that guy who put a bomb in his shoe, now we all have to pay for that.. (Just an example)

Keep in mind the FCC isn't taking away the ETF, they will be mandating possibly how much it is and how it will be prorated. If VZW or other carriers don't like it, you'll probably see the cost adjusted in things like activation and upgrade fees.
