These frequencies aren't even in use right now by any carriers? how is this good spectrum?

Both the 1.7Ghz and 2.5Ghz bands are already slated for use by two of the majors...T-Mobile and Sprint, respectively.

The 1.7Ghz could easily be acquired by T-Mobile and folded into their portfolio to use during their nationwide 3G launch. Sprint on the other hand, I believe is at the market cap in almost every metropolitan area with its 2.5Ghz spectrum holdings. They will use the band for their WiMax launch later this year.

There is no market cap anymore. That was done away with in 2003.

I'm not saying that you're incorrect, but can you answer me a few questions if this is true?

If the market cap for spectrum within a single band also within a single market was done away with in 2003, then why did former Cingular have to divest spectrum holdings in several markets when they acquired AT&T Wireless in 2004?

Why are companies still required to do so when they acquire other wireless companies?

I believe that a market cap around 70 or 80 Mhz per market still exists.

Yeah, there is some kind of a market cap. It may partially be determined by the size and strength of competitors in a market, but there are still restrictions in place. It's nothing nearly what it was years ago, though.

on a side note,there's nothing i hate more than self-righteous governement agencies that interfer with the "free market"...not so free after all.
