While the ad may technically constitute false advertising, you have to consider that it was conceived before VZW (and later AT&T) changed their policies. I don't know what the legal situation is on this, but I would think that VZW unpredictably changing one of its policies shouldn't have an adverse affect on another company, in this case ALLTEL, since the original existing ad represents a somewhat significant investment on their part and they designed it to run for a certain amount of time to get the ROI they envisioned for it. VZW filing an injunction against the ad now would basically undermine ALLTEL's business case for the ad, due to circumstances entirely beyond their control.
That's just what I think, of course I'm not a lawyer, so who knows...
