So it makes Sprint desperate because they are keeping their share holder's and clientele's best interests in mind? Has AT&T or VZW made any moves to offer a viable solution or work around to this matter? As Rich has pointed out they too are affected by the ITC ban.

Hmmm, I realize that a workaround and a petition are two different things...but one would think that the two single largest wireless providers that entail more than 1/3 of the entire wireless subscribers in North America lobbying against this would be a "viable solution" if their argument were heard out.

You did include "viable solution" in your original post, you know. 😉

I love the arrogance of AT&T reps. It seems like they don't have real knowledge. They're just brain washed about their products. In business it's always a good idea to know not only the ins and outs of your product but also the product of your competitors.

Not to the same extent...some of AT&T's planned handsets are patent infringing, but not all, since AT&T offers handsets with chipsets from other companies other than Qualcomm.

You are kidding, right? Qualcomm isn't making chips to satisfy anyone but Qualcomm, the fact that all CDMA carriers made themselves 100% dependant on them, is immaterial. They are in the wrong.

The only reason people are "happy" with the Qualcomm chip is because they don't have any other choices and they don't know any better. Having only one producer of something very rarely benefits the customer.

The ban is legitimate and legal. personally, I hope this frees Nokia up to develop their own CDMA chip. Maybe then other manufacturers will step up and CDMA phones will work better and be cheaper. Right now CDMA phones are more expensive than GSM phones, mainly because of the Qualcomm chip.

Don't think that's the only reason. The average joe probably doesn't even know of this ban and can probably care less. And no, that's not the only reason why people are happy, and yes they do have a choice. Use it, or don't use it. Switch to another carrier, or be happy with what you have. Sprint and hopefully others are doing something to upgrade their phone selection, not just wait for this ban to be over with. Carriers would hurt themselves if the waited out a long ban. No upgrade phone development. I disagree on CDMA phones being more expensive than GSM phones. The most expensive phones at the momoent are GSM phones (woithout the Qualcomm chip)....iPhone is a perfect example.

It wouldn't have been allowed to be released. Imagine the stink that would have caused. Fortunately they decided to use the 20 year old slower then a turtle technology instead...🙂)

i think since the ban doesn't actually go into effect until august, the release would've been okay.
