IF I'm not mistaken software is the manufacturer firmware it the carrier. Also, the Instinct is the equivalent to a franchise player I doubt they will send it down the same route as the RAZR or any other device. That would be suicide. From what I've learned the device will hit the ground running, no other Sprint device has a 100% open source SDK.

Just a little more info to peak your interest, at the Webinar a Sprint official said the Instinct was designed with Android and Linux in mind and that Sprint plans to "embrace those environments with new devices in 4thQ 2009 to 1stQ 2010". So a version of Android or Linux should be available for the Instinct late 2009 to early 2010.
