Password protect your phone and tell the cops that they can have the password when they get a court order and a proper search warrant.

That's only a solution if they get it off of your phone and not from the provider, which it sounds like that's where it came from in this case.

The provider is not going to give them information without a warrant.

Umm...They will and DID provide them the information without a warrant. That's what the whole case centers around.

Which they have every right to ask for before giving it to the police as far as I'm concerned but your carriers concerns in this area are not those of the suspect and doubtful fought against as hard.
