If you purchased the phone at a subsidy and it is still under contract, I think it is still, legally, at best an open question whether or not it belongs to you or to the carrier.

There is no question of ownership. Possession is 9 tenths of the law. And in this case the other tenth would be covered by the precedent that no carrier has ever attempted to repossess a cell phone. And besides, most people who sign up for service do so through a third party vendor, who owns the device, not the carrier. So, what right would the carrier have in locking those devices?
If ownership were the only consideration, then every device that was shipped to a third party vendor should be unlocked by default,and only carrier owned devices should be locke...
