Ludicrous. $5M in damages my @$$. What did getting these texts do? Demolish your house? Make you lose your car and job? Impregnate your cat?

You have to understand its about punishing the offending company. If you sue them for $5 bucks they could care less and not even send their lawyers and nothing will change. But if its $5 mil in damages that will get their attention and get them to stop.

So you are justifying the amount? It's not about a "message". $50k is a "message", hell even $5k is a "message".

$5M is just plain greed.

Twitter is valued at $31 billion. 5k? that is .0000016% of what they are worth. Do you think they care about that little bit? Their lawyers would charge more than that. 50k? that is .000016% of what they are worth. Really? Again their lawyers would charge even more than that to fight this litigation. Might as well settle out of court for 25k and continue sending illegal texts.
