Shouldn't the electric company be in trouble because they improperly gave permission?

Must suck to be Sprint/Nextel, their Legal dept must be going into overtime.

"....oh well they shoulda thought this out first..."

Uh, did they not seek the consent of the electric company?

I wouldn't have known that you needed the land owner's consent, if you had the electric company's consent.

But, being omnipotent, they should have known better.

Absolutely!

Only the lawyers gain from these stupid class action lawsuits.

I am just guessing, but Texas law may limit lawsuits against utilities.

What really boggles my mind about these rediculous lawsuits is that the people who are "gaining" from these don't understand that the settlement paid out will only hurt the consumers. Companies don't eat loss, they pass it on to the consumers!!!

And if they pass too much of the burden on then the consumers will leave the company.

I agree, if they gave permission that is their fault. However, maybe Sprint was supposed to contact the landowners? Either way it's stupid frivolous lawsuits like this that cause the erosion of law in this country. Anyone will try to make a buck nowadays. 😡

I would really be interested in seeing one of the antennas they have stuck to one of these towers... It would give us a much better idea of what the big fuss is about.

If it is tiny, smack the land owner across the face and tell them to shut the hell up.

If it is a big ridiculus thing, then it makes more sense.

Even still, it's not like they are commandeering an acre of land or anything.

it's not about taking the towers down... they want a cut of the money.. this will force sprintel to either pay more or take em down...

It may seem frivilous but the point is that the electric company has the right to use peoples land for FREE so they can put up their electric towers. It's called a utility easement and there's nothing a property owner can do about it. That's all well and good but I don't think they should turn around and sell rights to Sprint or any other company and make money off something they get for free. This may not seem like a big a deal now but if this is allowed to go on what's to stop them from going further and selling rights to the use of their towers to anybody for anything?! Before you know it the electric company will be making all kinds of money and the poor property owner is just sitting their paying taxes on his land that the electric com...

That's a good point. The electric company is trying to profit by selling the rights to something they don't have. They're allowed to use poeples' land for FREE for elecrical transmission only. The poor land owners are paying all kinds of taxes on the land and the electric company gets to use it for FREE! Now they're trying to profit from it on top of that! Can you imagine the potential for profit it the elecric company starts renting out all their towers all over the country to anybody for anything?! While the poor land owners don't make a penny on their own land and are stuck paying the taxes!

And my bet is. The law suit is being brought to us by the SAME people who probably b!tched & moaned to Sprint, "We don't have good service out here! We keep having dropped calls! Put some more towers up! Give us free minutes!"
