OnePlus One Aims to Steal Sales from Flagships
I can already see the lawsuit
The entire point of trademarks is that they exist inside their certain arena... so for example, if you name a phone the One, and someone else comes along and names THEIR phone the One, you'd be able to sue on grounds of trademark infringement.
Or in another case, T-Mobile trademarked the color magenta. That doesn't mean that other non-wireless companies can't use that color anymore. It just means that another wireless carrier couldn't use the color magenta for their logo. This was taken to court when AIO was using some shade of pink/purple that was similar to T-Mobile's magenta, and T-Mobile won.
Trademarks are taken on an apples and apples basis, basically.
