Anyone who isn't blind could tell that they're the same thing, and even a blind person could if you handed both phones to him and had him touch the keyboards.

Heck, the people behind Typo don't even try to hide the fact, it is being explicitly marketed as a way to turn your iPhone into a Blackberry....

Ryan Seacrest can appeal in the middle of American Idol till he is blue in the face. This is a blatant infringement of Blackberry's only saving grace (since they gave bbm away). Tweak the design of the keyboard and call it done. There is no winning this for Typo.

It looks more like the Motorola Droid Pro/Admiral in that photo.

But it is a near perfect copy of the Blackberry keyboard.
