Yup. So it don't matter if Windows Phone isn't as much of a money maker. They still win. Ugh....I wonder if the Ubuntu phones will be the true Linux open source phones.

If Google is violating Microsoft patents, a ruling which has been upheld by the courts, then yes it is right for Microsoft to request licensing fees. Google doesn't get to weasel out of licensing fees just by making a product free.

But Google isn't paying them. Samsung, HTC, Dell, LG are paying them.

That's likely because Google will claim that they receive no revenue from Android (a blatant lie) and thus going after the OEM's is easier than trying to get Google to be honest about its finances.
At any rate, this is a traditional business lawsuit, lawsuits as a part of normal negotiation process for licensing fees...this is how companies have traditionally acted, Microsoft isn't trying to follow Apple's
scorched Earth policy and demand that these products be pulled from the market
