The german court obviously rendered a viable ruling. No one should hold patents and never intend to use them with in a certain time frame.

However, part of research and development, is to research if an idea has already been patented. The patent department is already overloaded with technology patent applications on a daily basis. Myself, like others often claim we like our ideas and should patent it. But, we often never ask ourselves if it has actually been patented before. Big tech companies such Apple, Google, Microsoft etc, should be using the research part of this department to investigate its own ideas. This saves time and money that usually gets pushed onto the customer. Apple should have had the chance to purchase the patent from ...

I think it's more of weather said patent will be used with in a certain time frame.

That's a good question Darkstar. I don't have an answer. However, I do know that some firms made up of lawyers and/or business people that hold patents, should show red flag to the patent office that the firms obviously have no need for patents other than trolling. The patent will never see culmination.

Many years ago, patent applications had to have a conceptual design along with a working embodiment to present in order to complete the application process. It appears now days, I can put my idea on a piece of paper, fold it into a paper airplane and throw it throught the patent office window while driving to work and then be presented with approval.

Exactly, if someone comes up with a true new idea, not some crap they say its new, they deserve to be compenstated. And fanboism being it Apple, HTC or anyone has no bearing.
