I live in NJ, and I do remember in the news when this event occured. Sure, it has to be proved, but, now anyone with a cellphone involved with an accident, the opposing schister is going to suponea anyone who texted, and these people are going to have to go through a legal expense.

Its illegal to text and drive, that is a good thing, no argument, there is no reason for that person not to keep their phone in their pocket and ignore the text or call, and then pull over park the car and answer. Its the drivers responsiblity.

Right now for better or worse there is a mobile device hysteria while driving. Yes it distracts, and texting beyound the doubt is the worst But I don't see lables on lipstick, hair driers, fast food bags stating it can cause a distraction. Nor hystria with 500 watt plus sounds systems that make the neighboring car rock from the bass boom, and please don't tell me thats not distracting.
