I'm all for safety but this seems like a stretch. I text friends and relatives not knowing if they are driving. Unless I'm a parent of a minor or them living under my roof, It's none of my business where they may be at any given time. It should be the sole responsibility and accountability of the driver to ignore or answer calls and read texts while behind the wheel. Trying to blame two seperated individuals seems like a ploy to increase court time. Who benefits from this? Lawyers. It should be cut and dry. You(the driver) are the one that holds total accountability of your vehicle. It should not matter what is happening around you. John B. At first I had the same thought. But I am sure it would require more than one text message exchange between driver and sender to be held liable. The ruling said that it has to be clear that both the driver and the sender are fully aware of the driver operating a vehicle while said conversation is happening and accident occurs.

I usually use every feature I have available to me to avoid having to look at my phone while driving. Hands free, voice activated features, and additional apps that would send a message on my behalf if I am driving. There are many options out there to help you stay connected even while driving. I know most people have the latest and greatest phones loaded with hands free features. 🙂

by that same token though all billboard ads should be illegal as well because the advertisers know the people reading them or looking at them are driving. It's a bad idea.

Let's not forget 4th of July Fireworks displays. There was a time I was driving over the Throgs Neck Bridge when you could see several displays simultaneously. That was pretty distracting.

Travel thru Wheeling, WV on the 4th on Interstate 70. As you pass over the Ohio River they let them off from a suspenion bridge about a 1/4 down the river from you.

Not everything is a distraction and you can't ban everything. I live in Pinellas County, FL. The beaches was the biggest distraction especially Gandy Beach. A lot of these hot dog vendors were beautiful women in "more to the imagination" bikinis. I am a male driver. Thank god they got rid of them a long time ago before I got my driver's license.

A valid point here is as the driver, your eyes should be fixed on the road. Not some billboard, cell phone, or anything else. Especially a cell phone. Whoever calls or text you can wait till you have gotten to your destination or pull over in some parking lot to answer a text or a call. Is it worth answering that phone or taking someone's life.

But honestly, you can't hold the sender liable for...
