John B. At first I had the same thought. But I am sure it would require more than one text message exchange between driver and sender to be held liable. The ruling said that it has to be clear that both the driver and the sender are fully aware of the driver operating a vehicle while said conversation is happening and accident occurs.

I usually use every feature I have available to me to avoid having to look at my phone while driving. Hands free, voice activated features, and additional apps that would send a message on my behalf if I am driving. There are many options out there to help you stay connected even while driving. I know most people have the latest and greatest phones loaded with hands free features. Smile
