I agree. Often if I know somebody is driving and I need to get a message to them I'll text them so that they'll get it after they get out of the car so I don't need to remember to send it to them. Also, nowadays most smartphones have a driving mode where it will read an incoming text out loud to you. Am I liable for an accident because I knew you were driving, even though I had no way of knowing if you would actually check your text while driving and not have a driving mode to read the text to you out loud?
