The claim that people would be confused by the AMAZON Appstore, which is installed by requesting it from AMAZON'S website and requires you to sign in with an AMAZON account and sells ANDROID apps, and think it is an Apple service, is insane. 100 percent looney bin material.

Agreed. I also assume by "resolve the issue" they mean "bend to Apple's will" as there isn't any middle ground here. Either Amazon keeps their "Appstore" and this goes to court, or Amazon changes the name of their store and Apple wins without a trial. There doesn't seem to be a lot of room for negotiation. Maybe Apple will request a percent cut of anything sold through the Amazon Appstore as recompense XD

Haha okay that was actually a good one... Amazon should use that one in court, see what they say... but remember it's only okay for Apple to steal things... 😁

even my young niece knows the difference between those two appstores, ahahah why the heck would an apple device user go and use something that offers android apps? as if it would work for them,,,

apple shows yet and again that they want to label all things existing theirs. ahahah..

maybe next time, apple bee's would be sued for being mistaken to be an apple store.. 🙂

Obviously you don't understand. Apple created the appstore name. Why would Amazon want to use the exact same name as Apple? Because of how profitable it is. Amazon totally ripped off the name and they should have to pay Apple.

Apple would never rip off something like that.

never knew you can just suddenly invent a word and say you own it.. 🙂

oh by the way they should come here in the Philippines and sue a motel/hotel for having almost the logo they have, even thought the said motel/hotel started way back even before there was APPLE 🙂

Its not the word itself. Its how the word is used. Since both the appstore and the appstore both are places to go and buy apps then its the same use. Now if you had an Apple hotel and the Apple iPhone then its not the same use of the word.

I think the appstore is better than the appstore. Which is which?

Come on, you can't seriously be defending Apple's position here....

There is nothing at all uniquely identifying or distinctive about the term 'App Store'.....indeed 'App Store' is the simplest and most natural way to describe something which is a store that sells....well...apps.

Now, if Apple had given their app store a unique and distinctive name....say 'iApps' or something...and Amazon came along and used that name for their own store, they'd had a point...

You can't, or at least shouldn't be able to, copyright, a generic description like 'App Store'....

I mean....Hostess could copyright the word 'Twinkie' but they couldn't copyright 'Golden Cream Filled Sponge Cake'.....Kraft Foods can copyright the word 'Jello', but they can...

umm. Who do you think came up with the name app? Apple did. They started calling smartphone applications apps before anybody even thought of it. The app store is a place to get smartphone applications. Just like you buy jello to get a gelatin dessert.

You can't say Apple started calling it the "App" store before anybody thought of it, that is simply something you can not say. You have no proof of that at all. Applications for commercially available computers have been available since the late 70s, I'm sure during those 42 years, SOMEBODY used the OBVIOUS short-form of Application and called one an App.

They took an already existing word, used the short form, and then added the word Store after it. That's all they did. There was no huge creativity here. They used a short word, and put the word store after it.

'App' is simply shore for 'application' and the word 'app' has been in common usage by computer users and others since the early 80;s.....for example in the phrase 'killer app'......which is an application which is so good that it justifies buying the hardware just to run that specific app, and the phrase killer app applies not just to computers, but to any electronic doodad....so you'll often hear people say things like 'Super Mario 64 is definitely the killer app for the Nintendo 64'.....;WordStar' was the first real killer app for home PC's...

People like you are why I loathe Apple. Along comes the Apple marketing department and suddenly technical jargon that has been around for decades means something entirely different. The word 'App' was around before the first cellphone existed. So, how could Apple have possibly invented it. And since there were no cellphones at the time, how could it feasibly be exclusive to cellphone apps. The truth is the term is extremely generic and Apple has no right to it. Any lawyer or judge who say otherwise is a liar and is abusing his position.
