at&t will not allow anyone to sign up for new service without a contract even if they bring in their own phone....I know this because when I worked for at&t I had that argument with customers constantly......they always thought that if they bought the phone outright they didn't need to sign a contract...but that's only true for existing customers, brand new customers have to sign a contract regardless.
