Washington DC and the rest of the World's civilization has had subway mobile service for decades.

Washington DC is a rarity in north america to have this kind of coverage. As far as I understand, this is popular outside of North America, but not here. I don't think any Canadian cities have subway coverage whatsoever, and most large American cities do not, either.

North America needs to be less restrictive but at the same time let passengers know they are not responsible for peoples negligence if they get distracted while on their phones and fall onto train tracks.

D.C. has a population of 600k, NYC has a population of 8 million. DC's Metro has 80 stations. NYC's MTA has over 400.

NYC's subway system was inaugurated on October 27, 1904. DC's WMATA Metro is only 36. It is safe to say that the older system could not anticipate the coming technological advances.

That is technically correct.
We also need to take into account that....
NYC's commuters brain capacity system was never officially inaugurated by the NY City dept. of mental health.
