As being an old phone dog myself and being in the wireless industry for a better portion of my adult life... I remember when 99.9% of cell phones were "candy bar" style and Motorola attempted to claim that the flip form and factor was their patent ... The absurdity of this claim was laughed out of litigation and was never taken seriously by the courts.... And now this happens?

I agree old dog; the speed of the decision was breathtaking. I'm afraid crApple, emboldened by this decision will threaten all other makers unless they agree to remove certain phones from circulation. They'll feel they can do no wrong now; we're all doomed I tells 'ya.

First, I'd like to say I'm NOT an Apple person. Quite the opposite actually.

The answer to "Who let this happen" is simple: For the most part, Samsung. Their internal Emails all but admitted copying directly, and those were used as evidence in the case.

Lesson learned by Samsung, and hopefully everyone else by proxy: "Be careful what you write down!". The paper trail will wreck you.

Wow, which Samsung employees had their names attached to those internal communications?
That's a major CLM (Career Limiting Move) , were these docs leaked by an employee, demanded by the court or a little of both....

Samsung won this case. They won the privilidge of giving apple 1.05 billion dollars, and they won the privilidge of saying that they are the reason apple products will remain as dull as they are today. If apple would have lost, they would have had to do, or change something to stay competitive and innovative. With this win being handed to them, we are saying that what they are doing is ok, and there is no need to change.

This verdict is the best thing that could have happened to Samsung. What they are doing needs to be changed, and with a company like samsung, we know that their products will continue to get better, and better, and we know they will continue to innovate. Samsung losing this case will have a better outcome for them then if...

Apple may think they won now but this ruling will not force companies like Samsung, HTC and others to give their designers more creative license. This could be a very good thing. Thanks Apple I'm now ten times more interested in future Android devices than I ever was

I think very much Apple wants its competitors to innovate- that's the whole point. They need to stop making "not-iPhones" and actually build something great.

This is nothing but good news for Apple and Android, and nothing but bad news for cynical handset makers that were literally just ripping off of trivial interface elements instead of innovating.

Apple is waging nothing less than a war of extermination against Android, they will be satisfied with nothing less than the death of Android....and after Android is wiped out, they will start moving against Windows Phone and Blackberry as well until they are wiped out and Apple is the only company that is allowed to sell smartphones.....and with this, Apple's arrogance is magnified 1,000 fold....Apple now thinks it is literally bulletproof...Tim Cook is now laughing his ass off about how the legal system is just Apple's plaything, judges and juries, their toys...Steve Jobs was often accused of having a God complex, well I don't know what is higher than a God complex, but Tim Cook now has it...

One thing is certain: this ain't over....and ...

That's a little dramatic. Samsung isn't going anywhere, 1 billion is a lot, but I think they're doing just fine. I'm an android person myself and I an at least acknowledge that certain patents may have been infringed upon. Even so, I'm not worried. Something like this is needed every once in a while to stir up the stagnant uninnovative companies.

They don't care about Samsung, they care about Android.....they want Android gone, completely, Steve Jobs said so publicly, and Tim Cook has not budged an inch from Steve Jobs' position that Android deserves to be extinct...

Dude, what? I have a hard time believing that. And even if they did, it was probably within proper context. I don't like Apple very much at all, but I sincerely doubt that happened.

Motorola's problem is that they kind of stumbled onto the cell phone business almost by accident, they were quite successful making the technology to make mobile networks work and selling it to telecommunications companies and when they had a mega hit on their hands, namely the RAZR.....they overplayed their hand...and by the time flip phones stopped being trendy, it was too late because all their traditional core business was pretty much gone...

But I think they'll do okay in the long run...

but I think the removal of "Local Search" on Galaxy Handsets is an unfortunate side effect. I don't believe such a fundamental feature, which has been on home comptuers for years, should be restricted.

same here - now that they are forced into some Real innovation, some Real thinking, their next-generation devices will be better than ever. Apple shot themselves in the Foot on this one. Samsung will come through, can't wait to see what they'll do with the Galaxy S IV

They kind of already have. The original Galaxy S (certain versions) may have been a bit similar in design, the SII slightly less so, but the SIII is so far and away from being anything like an iPhone in design or function that its not even funny. And despite some criticism over looks (personally I think they look sexy in person, and I am enjoying the hell out of mine) Samsung is selling millions. Galaxies will only continue on their own path. I too am interested to see what they do with next year's iteration, even though I'll likely not be in the market for a new device yet.

Is already coming from Android anyway....Apple has been playing catch up since at least 2010...which is why the last 2 iOS updates have added nothing except features that have been available in Android since day 1.

I totally agree. And they will still be playing catchup - current rumour is that the iPhone 5 will not have NFC support, something that can be added to any android phone that supports a micro SD card . That doesnt really sound like innovation to me, sounds like a big step backwards.

Too bad (for them) after all the fuss all they can do is ban 1-2 year old devices that aren't really sold much in stores anymore, and which will very likely be able to get around the ban in short order with a simple software update.

The $1B might sting a little, but having to carve away a few infringing effects from TouchWiz for a few devices nearing EOA probably won't.
