The answer to "Who let this happen" is simple: For the most part, Samsung. Their internal Emails all but admitted copying directly, and those were used as evidence in the case.
Lesson learned by Samsung, and hopefully everyone else by proxy: "Be careful what you write down!". The paper trail will wreck you.
